| Terms and Conditions of Contract |

The following Terms and Conditions of Contract (the Terms) shall apply to all orders for "Jenks' Bolts" Products (the Products) received by Jenks Bolts from any party (Customer). Any variation from these terms shall be agreed in writing and unless the variation is accepted in writing these terms shall apply.
1 Prices
1.1 Retail Prices as shown on the Jenks' Bolts web site and in the "Jenks' Bolts" published catalogue are for information only and are not an offer to trade.
1.2 Retail Prices include VAT, insurance and delivery by carrier to all UK destinations.
1.3 Distributor price lists are confidential and for personal use only.
1.4 Distributor prices exclude delivery charges and VAT.
1.5 We reserves the right to change or modify prices at any time.
1.6 All quotations made are based upon information received from Customer: quotations are in GB Sterling and are valid for 30 days from the date of issue.
1.7 All quotations are based upon costs which are prevailing at the date of quotation and we reserves the right to amend the price details which are contained in ÊÊquotation if changes in the costs or other circumstances that are outside the control of Jenk's Bolts.
1.8 No discounts are available, unless agreed prior to processing the order.
2 Orders
2.1 All orders are accepted subject to these Terms and any variation must be agreed in writing.
2.2 Orders are processed in order that they are received and stock allocated on a first come, first served basis.
2.3 Orders are normally dispatched from our Lincolnshire facility.
3 Payment
3.1 Unless agreed in advance full payment is required with each order.
3.2 Distributors with a satisfactory trading record may be offered credit terms:
3.3 Pre-payment is accepted by a sterling cheque drawn on a UK bank or may be collected from the Customers debit or credit card using the Nat West Streamline Merchant Service.
3.4 All payments shall be in GB Sterling, unless agreed otherwise at the time of order.
3.5 All invoices are subject to UK VAT Regulations rate ruling at time of invoice.
3.6 Invoices issued to customers with an arranged, open account are due 30 days from date of invoice.
3.7 Payment by account customers must be made by bank transfer or cheque of GB £ funds to our UK bank, all bank charges are at the customer's expense.
3.8 We reserves the right to add interest at 5% above the LIBOR rate ruling on the date of invoice if invoices remain unpaid beyond terms agreed.
3.9 Ownership and title remains with Jenks Bolts until all invoices are paid in full.
4 Trade Marks
4.1 The "Jenks Bolts" Logo are Registered Trade Marks and may not be reproduced without agreement.
5 Force Majeure
5.1 In the event that the supply of Product is delayed, hindered or prevented by act of God, fire, tempest, war or war-like operations, civil war, rebellion, revolution, disorder, riot, strikes, lock-out, Labour dispute, failure by supplier, governmental restraint, or other contingency caused beyond the control of the Jenks Bolts, then Jenks Bolts shall not be liable for any loss or damage thereby incurred or sustained by Client.
6 Liability
6.1 Jenks Bolts shall not be responsible for the acts, defaults, errors or omissions of the Customer.
6.2 Jenks Bolts shall not be responsible to the Customer for any loss, cost, damage, claim or other matter howsoever arising.
6.3 The fitting of Jenks Bolts Products to a motorcycle may contravene Construction and Use Regulations pertaining to the use of a motorcycle on the public highway. In such cases the Customer is responsible for ensuring that the motorcycle is used only for closed circuit competition or display purposes.
6.4 The Customer shall indemnify Jenks Bolts from any costs, claims, damages or consequences whatsoever made against Jenks Bolts arising by virtue of the use of the Products. |
